Question:

A person sells copy/ fake products like handbags, shoes, intimation jewelry. Original products are very expensive, the copy/fake products are almost exactly same as original but very cheap as compared to the originals. While selling he informs the customer that it is not original, it’s a copy. But the end user/ customer may use/show it as if it was original. This transaction is illegal as per law of the country where it takes place. Please guide, if the income earned through this business is halal or not?

Answer:

In the Name of Allah, the Most Gracious, the Most Merciful.

As-salāmu ‘alaykum wa-rahmatullāhi wa-barakātuh.

If the seller informs the customer that the item is not original, rather it is an imitation or copy etc, and the customer willingly buys the item, the transaction will be valid. The income from such proceeds will be halal.

If the selling of such items is illegal in any country, that does not make the sale of such items impermissible. However, a Muslim should exercise precaution and avoid being convicted and embarrassed. Rasulullah ﷺ advised:

عن حذيفة قال: قال رسول الله صلى الله عليه وسلم: لا ينبغي للمؤمن أن يذل نفسه

Translation: Hudhaifah Radhyallahu Anhu narrated that Rasulullah ﷺ said “It is not for the believer to humiliate himself”. Sunan At-Tirmizi [2254]
